TERMS OF USE AND SERVICE AGREEMENT

These Terms of Use ("Terms") are entered into between Nail Akdağ ("Developer") and the individual user ("User") who downloads or uses the Baby Wallie app. By installing or purchasing a subscription to the app, you agree to these Terms.
1. Definitions
App: The mobile software and all related services offered under the name 'Baby Wallie' in iOS/Android stores.
Content: Text, photos, videos, audio, measurement data, etc. uploaded by the User to the App.
Forum: Community feature where users can share experiences and ask questions.
Paid Service: Features offered via subscription or in-app purchase as digital services.
2. Subject of the Agreement
These Terms regulate the conditions of use of the app, the scope of paid/free services, and the rights and obligations of the parties.
3. Account Creation and Accuracy
You are responsible for the accuracy of the information you provide when creating an account. If you are under 18, parental consent is required. You must keep your password confidential; you may be liable for damages arising from unauthorized use by third parties.
4. License and Intellectual Property
The Developer grants a non-transferable, limited license to use the app for personal and non-commercial purposes. The code, design, database, and brand elements are protected. The User may not reverse engineer, decompile, or make unauthorized copies of the app.
5. User Content and Forum Guidelines
Copyright in the Content remains with the User; however, you grant the Developer a worldwide, free right to use the Content for the purpose of providing and improving the service. Illegal, obscene, violent, or hateful material, works copyrighted by others, and data that violates the privacy of third parties are prohibited. Forum posts must be respectful and relevant to parenting topics. The Developer reserves the right to moderate and remove inappropriate content.
6. Paid Services, Payments, and Refunds
Subscription Plan: 59.90 TL/month – 3-day free trial. Only App Store and Google Play payment infrastructure is used. If not canceled before the end of the trial period, the selected plan will be charged. As this is a digital service, the right of withdrawal may be excluded under local law. Refunds are managed by the relevant store in accordance with App Store or Google Play policies. Prices include VAT.
7. Health and Liability Disclaimer
Development suggestions and other information provided in the app are for general informational purposes only and do not constitute medical advice. Forum discussions are user-generated content and do not represent professional medical advice. You should consult your doctor before making any health decisions. The Developer is not responsible for incorrect data entry, interruptions of third-party APIs, or loss/damage due to device compatibility issues.
8. Modification and Termination of Service
The Developer reserves the right to modify or terminate the app and pricing with prior notice. If the User violates the Terms, the account may be terminated. When you request account deletion, your personal data will be deleted or anonymized in accordance with data protection and retention policies.
9. Updates
You may need to update the app for new features or patches. No performance guarantee is given for devices that do not meet the minimum system requirements.
10. Limitation of Liability
The Developer limits liability for indirect, incidental, special, or punitive damages, data loss or loss of profit up to a maximum of the subscription fee + 3 months' fee. This limit does not apply in cases of intent or gross negligence.
11. Force Majeure
Neither party shall be liable for delays or service interruptions caused by natural disasters, war, cyberattacks, power or internet outages, or official government decisions.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Turkey. Users who qualify as consumers may apply to Consumer Arbitration Committees or Consumer Courts. For other disputes, Istanbul Anatolian Courts and Enforcement Offices have jurisdiction.
13. Effectiveness and Amendments
These Terms are effective as of 10.07.2024. The Developer may update the provisions by giving 30 days' notice. Continued use of the app after the updated text is published means you accept the changes.
